I had always thought it was supposed to be by January 31 but someone else said it's not til the end of February. Which is true or is there even a due date?

If you don't receive your Form W-2 by February 15, contact the IRS for assistance at (800) 829-1040. Also, you may want to refer to Tax Topic 154, Form W-2 - What To Do if Not Received...

Legally, your employer is required to give you your W2 by the end of January. However, if you don't get it, that is another matter. You can't sue them or anything. Of course, you have to get it eventually or the IRS will be after them. But, how do you prove it was not lost in the post?

They are legally supposed to have them postmarked by January 31. If they do not have them to you by that time, you can file a complaint with the company. Make sure that you call and talk to the accounting department first, because maybe there was a problem or something.

Most employers get the W-2's to their employees by the 1st week in February. You should ask your supervisor to look into why you haven't received yours yet. They may have a wrong address for you.

Federal law requires that they provide them by Jan 31

If your employer does not furnish you with a W-2 Form, you can still file your tax returns. You will, however, have to fill out Form 4852: Substitute W-2 Form and furnish to the government along with your tax returns. Legally, they need to be postmarked no later than 11:59pm on Jan 31. If you don't have it yet, call the IRS and report your employer.

They are required to mail them by January 31st. If you haven't received them by now you should contact the IRS.
