My minor son has been involved for first time in shoplifting and has been caught, the shop attorney has sent me a $250.00 bill and wants me to pay, and otherwise he will take me to court.
Can he legally do that or not.

If your son stole that amount of merchandise from the store, they can absolutely demand restitution. If your son is under 17, then he can be charged as a juvenile for stealing under $500. If he is 17 or older, then he can be charged as an adult. You (or he) could be sued in small claims court to repay the loss to the shop as well.

I don't think so. My daugher was caught in IL. She took some hair gel. They tried to make me pay for it but they wanted to keep the gel. I refused. I never heard about it again. If the owner got to keep his merchandise I don't think he can legally do anything to you. If the merchandise is missing or destroyed he probably can.

Personally I think your baby boy is getting off easy. Next time teach your kids not to steal and you won't find bills for stolen stuff in your mailbox.
