I have field a petition in the lower court to see my child I got only dates from the court so I had get direction two times from High Court to pass order within time frame fixed by high court but still there was no respect for the high court order by the lower court, lower court had only passed orders only after 15 months,
I did not get justice so I went for an appeal before the high court against order by lower court the high court had heared the matter 7 months back and reserved the orders till date no orders have been passed by high court.
If court is not even able to decied on a simple issues of father visiting the child, does not close the case by passing order keep it pending along with 1000 of case in cold storage, where will we get justice
I have field an interm petition pending for 2 yrs when will the court pass the order when the child is 18 yrs old a major when court will have no right to pass any order in the matter?

If wishes were horses everybody would be riding them. Although Justice delayed is justice denied yet Justice is Just Ice. Nobody gets justice from the courts. The only thing available is the best solution to a situation. But it also depends on the laws, case citings, attorneys, judge's beliefs (conservative, liberal), work load on the judge etc. and money both parties are able to spend. And there is always a gender bias in favour of female party whenever there is a family case.
To be fair, the courts have to deal with a lot of cases and sometimes they are understaffed or have other administrative duties to perform. Inspite of the judges trying their level best to dispose off the cases in a speedy manner, it is humanly impossible to decide all in a short span, especially in developing countries.
Take heart from the fact that you are not alone. I was once a member of a Yahoo Group "Fathers Are Parents Too" and read the same stories from everywhere: Germany, Canada, UK, Pakistan....
I do not know how old is your child, how long (s)he has been with you as a parent and what were the circumstances of your separation but I will suggest the following:
- Decide once for all what are you looking for? A revengeful life with stress on Rights or a forgiving one with stress on Compassion? What is more important - your right or dealing with the effect on child's mind?
- Forget about justice. Reconcile with the fact that you will have to live without your child.
- Try to communicate directly by sending gifts, books etc. using courier services. Of course, you cannot be sure if these will reach your child or not.
- Continue to pay child support to your ex as legally and moraly required.
- Network with third parties who are common to you and your ex. Ask them for help.
- Pray to God, if you believe in one. If you don't then perhaps this is a chance you might wish to take.
- And keep following the legal proceedings....

Sorry to hear about your dilema. Just keep pushing the issue. The squeaky wheel is the one that gets oiled.
I think people have a misconception of what the courts and law enforcement do. The bussiness of this people is law not justiced. An outcome of a court desicion may not be fair or justiced but it can still be legal. Dare I say, slavery and Salem witch trials?! In short, the law and justice are not necessarily the same thing. But, that is all we have. We try to make things as fair as possible but the system is not perfect.

In India hoping for justice in the court is just waisting time. This is the only reason why these underworld guys or unsocial elements are flourishing.
In opinion there should be a lie detector used in the witness box.Genuine people who are trapped in this net will be ready to pay extra charge for it. Unfortunately I am one of them. The judge smiles on the reason given by the lawyer of the respondent and gives the next date.
I think I am going to lose my temper very soon and the charge for the contempt of court will be on me

the court is made for giving justice and i do think justice is given to a person unless and until the opponent doesn't bribe the lawyer or the judge.
