Just because he didn't advertise the fact doesn't mean it's illegal. The fact is the NSA is like a giant electronic communications vacuum cleaner, it sucks in everything, analyzes, and stores it.
Generally speaking they are prohibited from performing domestic surveillance, but if you use any of a number of keywords or are talking to someone overseas especially if the other party is under surveillance you can be monitored. Additionally their is a secret court, that issues warrants to NSA for certain domestic surveillance programs, however the NSA is given some latitude to preform surveillance for a limited time without first acquiring a warrant.

Sometimes, we must lose our freedoms for a greater cause (i.e. catching terrorist elements). Besides, this wire tapping is no longer a secret. It is now done in the day. Please understand!
