Well, if your spouse has filed, you will get served, as it is a court matter. So, the other person cannot go through all this without you being served.

Is the spouse living in a different state? Most states, and specifically, counties have residency requirements. Meaning, the party filing must have lived in that county for X amount of time before they can do such things.

But, you will get served if they have filed any sort of papers with the court.

Most states have no fault divorces. Meaning, you don't have to have a reason to get divorced. And, there are usually waiting periods between the initial petition and being granted the divorce. I.e. in Texas, when you petition for divorce, you must wait 60 days before it will be finalized.
