As mentioned, you cannot patent a color. You could patent the design for a machine that makes paint, but not the color of the paint it produces. Nor could you copyright the paint (you could copyright a painting you made with the paint though). The legal protection that could come into play here would be a trademark.

Which leads to two questions: First, does Ferrari have it's traditional red color trademarked. I've never seen it listed as a trademark of Ferrari, and the color is readily available from both Ferrari's OEM paint suppliers, as well as other companies. If they did have a Trademark, the fact that they are doing nothing to protect it would mean it could be in danger. This alone would tend to imply they don't have a Trademark around this (and for note, Trademarks would only apply to the situation/industry for which they are applied, so an Italian Racing Red Sports car could be a trademark, but that would not protect against a Red Airplane).

The second question that comes to mind would be, if they did have a Trademark, could it actually be protected? Registering a Trademark and actually have a legitimate and protectable Trademark are two different things. Since the core of this would probably come down to trying to register "Italian Racing Red Sports Car" as a trademark, I think it would fail in spectacular fashion (many sports car companies came before Ferrari, and used the same Italian Racing Red).

No. You can't patent a color. You could try to trademark it, but it would be very hard to do. Harley Davidson tried to trademark thier engine sound once, but other motorcycle companies complained and so they were unable to do it. I think the same thing would happen with paint. Plus, any good bodyshop would be able to duplicate the shade anyway.

Man how can it be though those babes looks superb in that red paint job.... just think about it..... If Ferrari patents the red color then no auto company would be able to paint their vehicle red... Do u think it is possible.

No. Things like colours or scents cannot be copyrighted.
