Your car insurer at that time will have to foot the bill. If the car insurer cannot pay the whole settlement fee for the person suing you, the court may require you to pay the remainder of the settlement. At the same time, you may be required to serve some time in jail/prison.
You can't declare bankruptcy because you are afraid that you are going to owe someone a large financial settlement. Your bankruptcy case will be considered suspicious and thrown out of the bankruptcy court.
My guess is that your insurer will refuse to pay for the damages of the person suing you because you were driving while intoxicated and there is a good chance that person will be awarded some financial settlement. You will more than likely do time, but it won't be a long time, unless that person suing you is incapacitated. Count your blessing that person did not die. You would have been charged for vehicular manslaughter at the very least.
What can you do? Do not drive drunk, for goodness sake. I hope you learned your lesson.

If you make $10 an hour and don't really own any property (houses, cars, stuff like that) you can declare bankruptcy and discharge most debts from judgment, including this one.
Get a lawyer, they should tell you the same thing. Settle the case or do whatever, but after that happens and the judgment is final against you and is entered with the county clerk, you can declare bankruptcy and it goes away.
You won't go to jail. This is a civil suit.

If the person in your car is suing YOU for brain damage when you crashed while you were drunk, then you should make sure to let your lawyer know to ask why they got into the car with you in the first place.
That might shut them up a little.

They aren't suing you really. They are suing your insurance company. If your insurance company pays, you are going to get dropped immediately and getting insurance in the future is going to be next to impossible. You also might get sued by YOUR insurance company to recoup their losses. In which case you will have to file bankruptcy or lose everything. You need an attorney my friend. Immediately !

but i will say; i hope you learn your lesson and i hope you get wat you deserve, not sounding rude, but if it were my own family i would still say the same. i can't stand to see/hear of ppl driving drunk. and 9 times out of 10, the drunks don't suffer any, it's always the undrunk that has to suffer. i hope you get your life straight and you better hope i don't cross you on the roads driving drunk, cuz i'll surley call you in....

you wont go to jail, its a civil case, not criminal. i donno what will happen, probably have to pay it for the rest of your life. i dont feel one bit sorry for you; i do for the other person though. get a lawyer, it will be beneficial.
