My husband's employer is constantly changing his schedule after posting it. Sometimes they change it the day before (which has to be illegal!) without even telling him. Usually they make schedule changes and post a new schedule within a few days before the schedule (2-3 usually), but still do not let him know (example... we were on Vacation over the weekend and came back today to find out that although he checked the schedule before we left on Thursday and he was to work 11-6 tomorrow (Tuesday) he is now working 3:30-10 and he only found this out because a fellow employee called him to ask him if he would come in earlier). He also just got a promotion and is supposed to have some more training before working alone but is now scheduled to work alone tomorrow. I know the employee is responsible for checking his schedule but this happens EVERY week. It's hard for us to manage with such constant schedule changes and so little notice! This is in Oregon, by the way.

Usually they should call and ask before they even change it do to the fact that they already posted a schedule and you could be unavailable for that switch. HOWEVER they don't have to be nice and courteous so I'm going to say at least 24 hours with some type of notice, like a memo or call saying to check the schedule do to some changes. I would tell your husband to check the handbook about scheduling and changes and if its not in there just have him ask the rules about it so hes clear. If they tell him some mumbo jumbo about there not being rules that's crap, that has to be some written form about the way the boss or manager does the scheduling, and to go to someone in like HR or whoever can help him, they can't just keep stringing him along like this. I was in a similar situation and I went to HR and asked them how they were supposed go about schedule changes and they sent me a big packet of paper work with it stated word for word. So Hopefully your husband will find something like that! GOOD LUCK i know what he's going through!

The answer should be in the Union agreement. If it is not you have a bad union Representative.
If he is not in a union then it is the companies choice how they want to treat employees depending upon total hours worked per day or week.
