My divorce was final less than 2 months, and my ex is filing a modification--apparently unhappy that I get to be with my kids at least 3 days a week---was just curious if a judge will just throw her petition out since there is no merit for the change and its only been 2 months

Different states have different laws it might be prudent to file for enforcement if the other side has not kept the agreement other wise it is usually a year before a modification can be done and that it is as bad as the divorce itself unless there is clear evidence it is in the best interests of the children or they are in danger. This is why I advocate that people settle only for what they are willing to tolerate with so that if the other party re negs enforcement can be effected and most judges will modify after a few enforcements

Talk to your attorney and find this out. I really do not know and what kind of a modification are you looking for?
