If you sent it from or to a work email address or computer, they likely don't need a subpoena. The company likely has a policy in place that says that they can look at anything on one of their machines or email accounts.

Otherwise, I suppose it's possible that they could if they wanted to.

I don't think they could get a subpoena for anything unless there was a criminal investigation or some sort of civil lawsuit. With that being said I don' think they need a subpoena because they probably already have access to it anyways.

Wow, you are SO f***ed.

They don't need a subpoena. You're just gone if anyone pursues it. You'll be lucky if you don't get sued on top of getting fired.

As long as you used a company computer and company email and on company time then yes they can get whatever they want and they are well within their rights to do so.
