YOU SAID IT MY SON, YOUR MOTHER DID NOT HAVE THE RIGHT TO CLAIM YOUR SON AND SHE WENT BEHIND YOUR BACK, THAT WAS NOT RIGHT. YOU SHOULD ASK HER FOR THE THOUSAND OR TWO DOLLARS SHE GOT FOR YOUR CHILD. SHE IS TAKING FROM YOU AND YOUR CHILD. WHAT KIND OF MOTHER IS SHE. YOU NEED TO LET HER KNOW SHE TOOK A GREAT BIT OF MONEY FROM YOU AND YOUR CHILD. YOU SHOULD ALSO ASK HER WHY WOULD SHE DO THIS BECAUSE IF YOU HAD TO LIVE WITH HER FOR SIX MONTHS YOU REALLY NEEDED THAT MONEY. IF SHE DID NOT TAKE CARE OF YOU AND YOUR SON FOR A YEAR SHE HAD NO RIGHT TO CARRY YOUR SON. EVEN IF YOU DID NOT WORK FOR THOSE SIX MONTHS, SHE STILL DID NOT HAVE THE RIGHT TO CARRY YOUR CHILD. MY MOTHER WOULD HAVE NEVER DONE SUCH A THING LIKE THAT TO ME. SHE WOULD WANT ME TO GET ALL THAT I COULD TO TAKE CARE OF MY CHILD. SHE SHOULD HAVE GIVEN YOU ONE THOUSAND DOLLARS TO HELP YOU BECAUSE SHE GOT THAT MUCH OR MORE FOR YOUR CHILD.

That's an interesting question . When in doubt, read the IRS instruction - Very dry reading, but all you need to know is there.
You can always call the IRS toll free number (Telephone Assistance for Individuals: Toll-Free, 1-800-829-1040) , also.
Here is a link to the appropriate IRS instruction on the subject - Table 3 is the info you need:

You are the birth mother. That trumps just about anything. Including the father in most states. But why were you living with you mother anyway? Where's your husband? You DO have a husband, don't you????
