I'm rather confused about this: If Hillary Clinton wins the 2008 race for the presidency, what will happen to her post as NY senator? She would still have 4 more years as senator...and you can't be in two places at once (Albany & DC).

Edit: OOPS, I forgot Hillary is US senator and not State senator...therefore it wouldn't be as hard to be in the Capitol and the White House...

Should she (or Barak Obama) win, they will step down as Senator and someone else will be chosen by the Governor of their respective state to replace them. They should be from the Democratic party, but I don't know of a law that specifies that.

It's unconstitutional to hold the 2 positions because the point of the legislative branch (senate) is to keep the executive branch (president) in check. She/he can't be responsible for checking themselves.

No, if she wins the Presidency

Years ago in order to run for the Presidency you had to even give up your seat. They changed that quite a few years ago… Cant remember exactly when…

Reason being is that you can't hold 2 posts if you ARE President.

More than likely they changed the law so more Reps and Senators would try for office. You nitice today we get 5 or sometimes 6 people in the Primarys.

N O, A replacement would have to selected by the governor of New York and is suppose to be a member of the democrat party to serve out the rest of her term as Senator.

No....she would vacate her position and they would have an election to find a new senator to take her place. You can't be a senator and president at the same time.

No she can not hold two positions of power as that. If she holds prseidency she has some of the same powers as Senate, but she will be more powerful and statute will be that over a senator. She will do some of the same jobs as senators but ore such as passing bills. The bills that Senate tries to pass, she willo have a say so as in if they ill be vetoed, of conitued, etc

Mrs. Clinton can not be president and senator at the same time. She can only run for one or the other.

She would give up her Senate seat, as you cannot serve in both the executive and legislative branches (separation of powers).

And she is the US Senator from New York, serving in Washington, not a New York Senator serving in Albany.

Oh, really, you can't be in two places at once? Well, there's something new I learned.

To be serious, yes, she will lose her seat as senator. However, she can run for president and still be senator. It is only if she becomes president that she must vacate her seat.
