I bought a memory chip from this guy (fourniersean) on e-bay. When he was selling the chip he said that the memory will work in Gateway 5300. After I installed his chip it did not work. Then, when I asked him for a refund he said - just add $25 and we will replace the chip. Of course I did not go for that. When I asked for a refund he said "We will not give you the money back because you just bought a wrong memory.
Now I know I bought what they advertised, and also when they were selling the chip they had my computer model listed.

my question is: What would you do now?

Dealing with ebay can really be a problem, and unfortunately sometimes there is hardly anything you can do to get your money back, which is sort of a pain. Ok, first thing to do is to contact ebay. Go onto their site where you can log a complaint. You need to have all the emails that you have sent back and forth to the seller, showing that this seems to be a scam. I would say that he is offering something that doesn't work and he is offering to upgrade it for $25 more, off of ebay is a sure sign that something isn't right. Ok, place a complaint. It may do something, or it may not, but you have nothing to lose and it's a place to start. Next, this is a problem as you haven't mentioned how you paid. If you paid by PayPal you have some recourse. You can contact them within I believe 90 days and tell them about a fraud, and place a complaint there. Also, if you put it on a credit card you can call the credit card and have the charge reversed, or held up while the charge is investigated. Can't guarantee that you will win, you may be out the money,but at least you will feel better that you are trying to do something about all of this. Did you check the feedback of this person to see if he has done this before? Always check feedback when buying something, and don't buy computer items from ebay, they usually are bad and a scam. I know I'm telling you this too late,but better to know for the future.

did you pay with Paypal? File a complaint with them and also with Ebay, Paypal can hold and even take the money back out of his account.

If you paid with a credit card, investigate the possibility of doing a charge back.

If you paid with PayPal, you can file a claim with them. If you paid with a credit card or funded Paypal with a credit card, you can get your money back by calling the credit card company.

the only thing to do is to alert ebay, if you can't work it out with the seller. if he specifically stated that there are no refunds, you're out of luck.

I report them, and call them up and complain ALOT. Sometimes they end up doing the right thing, sometimes they don't. But those bad reviews will add up and will hurt them.
