I am Almost 18.
I have been living in Texas with my father(non-Custodial)
My mother (Custodial Parent) Lives in Indiana ( I was born There also)
And my Father Has continued to pay her Child Support due to the fact that a custody Battle Would Have Taken far too long to Get me out of a bad situation there,
I am getting Ready to go to college and I have been told that When I turn 18, My Father Still has to pay her Child Support(or Take her to Court) Due to Laws in Indiana
I want to Get her Rights Revoked however because the money is supposed to Go towards my continued Education.
& i know She isn't going to help me at all.
I think it would be better just to not give her the money in the beginning.

Please any help in how to do this would be Great,Thank you

As you state, in Indiana, the courts can require the ncp to pay child support until the child completes college.

(If the parents aren't divorced, they aren't required to support their children while they are in college. The rule only applies to children involved in child support situations.)

The only option is that your dad needs to file, in Indiana, to have the child support order changed. He can probably just hire an IN attorney to do most of the work, and might not even have to come back here.

There should be a divorce decree that states how long he has to pay custody. I thought the general rule in paying was until 18 years. He can probably get a lawyer and get custody of you since you are now living with him for the past two years. But, since you are technically an adult, I'm surprised he still has to pay.

Are you sure you have the facts right? In my state, child support must stop when the individual reaches 18 or graduates from high school--whichever is later. I've never heard of child support extending into adulthood. Your parents' divorce decree is a public record. Can you get a copy? Can you have a friend or relative with whom who have a level of trust go to the Court and get a copy?

When you turn 18 and move out he wont have to pay as long as you not living at home and going to school/college. Only then will he have to pay. Look up the laws on line in texas.

You may have been able to petition for emancipation to end her rights 2 years ago. As to your current question Check with a lawyer.

Get a lawyer for your daddy man. And i'm pretty sure he won't have to pay when you're 18.
