Every time we use the washer the system goes wacko. the toilet backs up with waste and so does the bath tub.MY QUESTION is what are my rights as far as a tenant ? you see the landlord has tryed to fix it 5times

You have to look at the specific landlord/tenant laws for the state or country where you live, but generally the landlord is responsible for providing repairs in a timely fashion. In this situation you've got a health hazard that must be corrected quickly. If the landlord is unable to make the repair himself, you should first ask him to send out a plumber. If he is unwilling to call a plumber and the problem persists, you are within your rights to hire a plumber yourself and deduct his fee from your next month's rent. Give your landlord a copy of the plumber's bill and keep the original, because you may get into a dispute over the need to have hired a plumber.

After 5 attempts, I'm surprised the landlord hasn't already called a plumber.

Ask him to call a plumber.He has to give you a sanitary place to live.Ask him if he would deduct the cost from your rent if you call a plumber out.
