I have gotten a lot of suggestions of fencing the property, just a note, Chickens fly, and very well. The guy told the Police that he is trying to bait the chikens so he can shoot them. The police have no idea if there are laws against that. Thanks, :)

The chickens usually stay on my property, the neighbor has been putting a trail of seeds from my driveway into thier driveway. I live in an Agricultural area, for the last 15 years, they just moved here from out of state and don't like the chickens crowing in the morning.

ooooo this made this alot easier see, if he baits the chickens on to your property with intent to kill them and you can find some type of evidence for that this would probobly fall under animal cruelty.
in cases like this the defense usually says the animals came onto their property and threatened them and or caused damage to them and or their property, which would give justification to use necessary force to protect the defendant and the defendants property.
but in this case saying chickens were a threat will be taken much more lightly then saying say a dog came on to your property.
so proving that the neighbor baited the chickens onto his property with the intent to kill them will be much easier, but still try to get evidence such as a video tape or pictures of the defendant doing something incriminating or get his statement saying that. to find more about legal actions you can take try calling up the humane society and ask about this or look into animal cruelty laws.
bob would also highly recomend you put leashes on your chicken, to make the leash all you need is string tie it around the chickens leg in that one knot bob forgets the name of it and tie it to a tree or somewhere where they can perch, cause bob used to put his chickens on leashes. that way they can walk around and go in the tree at night while limiting how far they can go. also if you put the leash on right it shouldnt hurt the chicken or get the chicken tangled. anyways good luck with your chickens and your case.
bob is back and almost certain this time the humane society says "If an animal is being hurt or indanger you may call the Humane Society Number 24 hours a day." which bob would recomend in your case
but also bob has found out thats the limit is 2 chickens in a residential area, bob is not sure if you live in a residential area this would probobly hurt your case if you took it to court if you had more then 2 chickens and live in a residential area and
roosters crowing for 10 continuious minutes or intermittently for 30 minutes is in violation of the animal nuisense law, those two things will probobly kill your case if you go to court. how ever bob still thinks you could probobly get him on a animal cruelty charge.
also if you get a restraining warrant on him if you comes on your property you can call the police and get him arrested.
everybody knows bob is the best.

Sounds like you are going to have to fence in the chickens just to be safe.You could probably fence in a pen relatively cheaply and then you could monitor what your chickens are getting into.
You are going to actually have to catch your neighbors baiting and or killing your chickens to charge them with anything.

I'd suggest you put up a fence so your chickens can't
get onto your neighbor's property. Therefore, they could
not kill them. Makes sense?

Don't know the law, but I can say I know a couple who got in truoble in small calims for baiting and poisoning a dog. They are there, look into the small claims

you need to call the police or lawyer. why don't you put a video cam out side so you can record them stealing your chickens. maybe you can get them like that. put them in a chicken coup.

State law applies. At the very least it is stealing. How to prove it is tough though. Can you videotape it and then call the cops?
