Make it as informal as you possibly can and put all of your soul and feelings into it!

If you make it formal it will appear that someone else wrote it.

How should it start?

Try this -"I was in the crosswalk after looking both ways to make sure that there were no cars coming in either direction when suddenly out of nowhere this car came flying down the street and knocked me down!" - or whatever -

"Since that time I have been in constant pain and can not do ------ or whatever and have a fear of crossing the streets now thinking that another car will knock me down again!!!!!!!!! - or whatever -

This is probably a letter to your attorney giving him information he will use when making a demand upon the insurance company of the driver to settle your claim. Make the letter businesslike and professional. Say something like this: "I was injured in an accident on (date). As a result of the injuries I sustained in that accident, I missed work ___ days (list how many days you missed work) I also incurred medical expenses in the amount of $____. Before my accident, I enjoyed an active lifestyle including (list the things you used to do such as traveling, gardening, dancing, etc). Since the accident, I can no longer (list the activities you can no longer do and be specific). Since the accident, I have constant pain and discomfort and have to take medications daily for the pain. (if that is the case)"

If there were any psychological effects, list those also. If there was any loss of consortium (anything effecting your spouse, such as you can't go dancing anymore, or that your spouse now has to take care of all household chores, etc.). If this has had any impact on your children, list the ways your life has changed in regard to your children.

Hope this helps.

I assume you intend to send this letter to your lawyer. If not, better ask him before you send it to anyone else. In any event, it does not have to be "formal". He is probably looking for how your life is today vs. before the accident. How have your injuries affected you on a daily basis. To be sure though maybe it would be best to call or e-mail him and ask him.

You should ask him for help if you need it, but my guess is that he wants you to give a lot of detail about how your activities are restricted as a result of the accident, and how you have to cope with pain and any other effects of the accident. You might want to just give an hour by hour description of your day, as compared to what you used to do before the accident.

I would say be yourself as having a conversation with a friend.
How is life to you since having the accident. What differences
now compared to then since your accident. How has the accident affected you in any way.

spew it all out first, then go back and review/reorganize. this letter does not have to be formal - your lawyer just wants your side of the story on paper and for reference in negotiation.

When a question concerning legal matters is asked, I suggest you ask an expert, not a web community. My answer, therefore, is to call your lawyer. Your attorney will answer. That is, after all, what you are paying for.

You can ask, but it's up to the attorney if he wants to do that or not. You'll likely have to pay him to write it.
