i have been married for the past 2 1/2 yrs and now want to get a divorce..my husband does not want this and wont sign the papers he said however i want to get divorced ASAP we still live at the same residence and have not been legally separated but i havent been home for the past 6 monthes bc i was away for training in the army and now that im home i never stay with him in our place together..can i divorce him without his signature can anyone help me out on this????

First of all what is the whole story here? Why do you want the divorce to begin with? What is so wrong in your marriage that cannot be fixed or helped if i may ask? Have you both tried marriage counseling yet? He may not want the divorce because he still loves you and wants the marriage to work. Find a lawyer if need be and go to court over this. I feel however that you guys should at least try marriage counseling and working it out at first before giving up on the marriage. JMHO

Yes, you can divorce without his signature or consent. But, you need to file a petition with the court seeking a divorce and he must be served with a summons and copy of the petition. He has an opportunity to be heard. If he objects the judge can still grant the divorce. You should have a lawyer.

Yeah you can divorce him. Just go to court hire a lawyer spend the $$ It will be no problem It sounds like you tried one of those do it yourself quickie things. Well those only work if everyone is on the same page

You can, it might take a little longer, but if you want out, then a judge can release you from your marriage, with or without his signature. Good Luck, and be safe in the Army,,,,God Bless,,,
