Basically, you just light it up and never put it to your lips. It would be similar to a candle that creates smoke (albeit less)

It comes under the statute "Lighting a cigarette with intent to smoke", or some such hogwash.
Legalese has ruined life for everyone. Whatever happened to a simple 'Sorry, you can't smoke here'?

I guess it would be considered first hand smoke, since it was never inhaled by a person and exhaled. After all, it is the second hand smoke that they are worried about. Light 'em up.

Yes it definitely would be considered smoking, and you would get a fine...if they can catch you.
