ok, so im 20yrs old and live in evansville IN, and my mom and brother live in st louis MO, my 16 yr old brother will be moving to evansville to stay with me for the rest of high school. my mom will still be very much involved and take care of his financials, etc...but incase of emergency, she wont be here as his legal gardian......if he goes to the hospital or needs to be enrolled in school, i need to have the authority to do so.....how do i go about obtaining it? and is it possible to just get partial guardian rights, cuz my mom is still his mom and guardian, i just want to be able to have say since she wont be here......any help wuld be awsome....

Yes you can. It is called joint custody. Just hire an attorney and file.

You will need a full guardianship with power of attorney. I have to have that for the job that I have for two little boys I nanny for whose parents travel a lot. You will need it to make all important medical, school, and any other legal decisions for him since your mother would not be there to sign papers or documents. This way you can communicate with her to help you make them or you can act on your own in his behalf since he is a minor. When ever you go to school, the doctor, or the hospital, you will need to keep the papers with you with your ID so they can be presented at the time. Every year they will need to be re-newed. I hope this answers your question.

This is a legal and binding document that has to be executed by an family law attorney.

As far as I understand the situation, I think that you can agree with your Mom and apply or set up Joint Guardianship, that shares guardianship without taking away anything from anyone

For anything that you will need for a long time period, go to an attorney and get a POA drawn up. Right now the mom can write a document giving you medical POA, have it notarized and you need the original copy. That will get him standard help in any medical setting but again for long term stuff get a legal document drawn up.

Tell your mother to execute a document that you are the guardian of your brother if she is not around.
