I live in a small neighborhood and the lot next to me is being turned into a gas station. I am really worried about this b/c our city council had a private meeting on the matter. The decision was made without the neighboring people. The gas pumps literally are on the other side of our privacy fence. I consider that unsafe for my children when playing in the backyard and smelling the fumes constantly and then the garbage will attract rats and roaches. How can they build something this close to our house without our input? Please if anyone knows anything to help I would greatly appreicate it for the safety of my children and neighorhood kids.

Council usually has little say if property usage is within zoning rules and complies with local and state ordinances. What you would have to look into is whether or not a zoning change was initiated without public input. Otherwise they are within their legal rights.

Well, it all depends on the zoning laws within your community. If the council allowed this, and it is within the zoning laws of your community, you will be hard pressed to get this stopped.

Also, concerning the answers about you should have had some input. If this was passed by the council, then it was part of a public meeting. The agenda for this meeting was public information. All this was likely announced and published in those legal notices everyone ignores in the paper. So, if changes were made to the zoning laws at a council meeting, and you did not attend, you missed your chance at giving any input on this issue. By not attending the meeting at the published time, you were in essence giving your consent to this action.

So, maybe a lesson can be learned here. Pay more attention to those legal notices, maybe start attending city council meetings, and you will get your chance to be heard in the future.

Contact an attorney, you may be able to file an injuction to stop the construction. Check to see how your council went about setting up the zoning for this gas station. They may have rezoned the area and there could be some room for legal argument. But don't let time waste

That effects your property value too, so you should have a say. Definitely write a letter to your town council. If nothing else, you could get a lawyer. I think writing a letter, or starting a petition, is a good start.

Got to make room for progress. I am sure that the station owners got all the permits. So you're stuck. Your only choice is to move.
