Can Your wife sign your name on a cash loan without your consent? Is this illegal and considered forgery?

She cannot sign your name, it is foregery. The exception would be if you gave her power of attorney.

If it is a loan with the bank you have a joint account with it might not be forgery. If you have at any time verbally given your consent to her signing your name to any document (let's say tax refund check) then in this case it would NOT be forgery. The only time it would be considered forgery is if she had never signed your name to anything in that bank before. What I question is why you haven't been to a lawyer to figure this out if it was of concern to you.

Yes it's illegal. My ex wife borrowed money against the title to one of my restored pickup trucks without me knowing it.She also signed savings account transfer papers at the bank without me knowing and transferred most of my savings into our checking account.She then wrote checks on the account and spent the money on what she wanted.The bank said I could fight it and win if I chose to but the legal fee's and missing time away from work would cost me more in the long run.Best advice to you is secure all your fund's and remove her from any accounts you may have.Try to file a legal separation and some kind of settlement showing that you are not responsible for her dept.

i might get a 2nd opinion from a lawyer. there is not any way it incredibly is criminal for a bigger half to forge yet another's signature. i think of those law enforcement officials in basic terms did no longer desire to handle what they see as a family contributors dispute.

This is illegal. In fact the lender can come after her and prosecute, she better come up with the money to pay it back or she is screwed. You on the other hand, might want to find a lawyer.

Please be careful with this. A member of my family got a divorce and the ex wanted a clause that all credit cards be paid by our family member. Found out after the ex had like 10 cards in others name - MAXED and nothing could be done about it.

but then again what kind of shady place would give a loan without checking an ID and coming up with the conclusion that her name is SARA and not FRED?
