Ideas and concepts without a fixed form of expression cannot be copyrighted. Once you write an outline for a script, or draw some samples then you have a fixed form and copyright is automatic, it does not have to be registered. Don't give away anything about your project except that it be in fixed form, and keep records as to who has been shown as it may be your "friends" that rush to the publisher first. Publishers know that these samples are protected by copyright so they are not apt to attempt infringement. Large studios protect their characters from unauthorized copying by others with Trademarks. This is expensive but the only effective method. perhaps your publisher would help foot the bill as part of his contract as it would protect his interests as well.

Unfortunately, the copyright laws generally deal with characters described by its "textual contexts." In other words, it must be in writing, not a character. It is more of a domain of the trade mark. However, for you to have proprietary value to the character, it must be known as a primary source to a certain thing. You know the Disney characters. The trade mark laws require you to show that the characters you developed has some kind of meaning to a source. Unfortunately, it is difficult thing to clear this standard. You should consult with the attorney specializing the trade mark. There is a really grate write-up on the website, which I site here below. Good luck.
