if i suspected someone was a Vampire or Werewolf, i mean they were acting 99% like one and KILLED them accordingly, stake and silver bullets.

Would that be against the law?

It depends on the circumstances. I guess that if you got it wrong and killed them illegally, your main worry might be the question of what rights surviving relatives of vampires and werewolves have under the law?

If you get into that situation, please let us know, in case we get into that situation ourselves. LOL.

Yes, it would be murder, in the first degree. It would be in the first degree because you would have planned it out, by getting the stake and silver bullets. Your lawyer would probably try to get you off on the insanity defense...but it is unlikely you would get away with it since our society as a whole doesn't hold much stock in the insanity defense, or vampires for that matter.

BTW, it would be murder EVEN IF you proved that the person/vampire/werewolf was murdering other people, because we are not allowed in this country to exact punishment on our own...best thing for you to do if you suspect someone is killing others is to report it to the police, and keep reporting it until someone there listens to you. You don't want to spend the rest of your life in prison.

If you suspect that someone is behaving illegally, then you are required to report their behaviour to the appropriate authorities. It is their responsibility to determine the legality of the "vampire" or "werewolf's" actions. Failure to do so, could result in charges of aiding and abetting.

By the same token, depending on the State, I believe that there are vigilantism rules in place in the civil codes that make taking the law into your own hands a criminal offense.

Yes, absolutely. Seeing as how general society doesn't believe in such things' existence, it would be murder. First degree murder technically. You'd have to buy the stake and/or silver bullets, which would be part of a plan or plot to kill someone. Definitely against the law.

You'd have to prove that they were a vampire/werewolf, AND that you had a reasonable fear that you or someone else was in imminent danger of bodily harm from said werewolf/vampire, at the time of the incident.

It would be manslaughter if it was self defence. I wouldn't mention the vampire/werewolf thing at your trial though, unless you want to plead insanity.

Murder is illegal. You do not have the right to kill anybody unless it is in self defense. If they attacked you, you could defend yourself. However, your force would have to be reasonable in relation to the force they used on you.

er...yes, but apparently you can kill a man with a bow and arrow at midnight if he has an apple on his head in Cardiff....i think...it was something like that, i saw it on the Richard and Judy show a few years ago.

Yes. PETA will be ALL over you if you kill an endangered species, even if it is one that drinks blood or kills people while howling at the moon.
