Afraid so my friend doing this would be considered as a public broadcast of the song.
The use of non lyrical music such as availible in MIDI format from the net should be ok but I am grey on that.
But using an MP3 as the song in total is completely illegal and could land you in a whole heap of Faeces the likes of which you would not believe.
Fines of 10s of thousands.
or
A prison sentence
Or both.
Its annoying really I know you are probably only paying homage to a favourate band or group or artist but the record companies are pretty anal about that stuff.
I'm not saying they'll catch you but I wouldn't run the risk.

Yes it is legal. As long as you are not stating that the music is of your own. You have to give credit to the artist who made the song somewhere in your site. Preferrably somewhere that it can be seen easily. It is also a good idea to link to the bands official site if they do infact have one.

In order to upload your music however, I suggest using 4shared.com and to make the playlist for your site I suggest using pixpix.net

Both of those sites are easy to use. And both have free membership.

Note:If there is no credit given it is illegal. Because then no matter how many people know who the song is by you are not giving credit to the artist.

As long as a) your website doesn't sell anything and b) you provide a credit to the original artist somewhere on the site, it's completely legal. Also do not make the song downloadable to visitors to your site.

If you say what the song is "Background Music - blah blah blah" then it's ok, but you might want to say the CD, Artist and song name at the least. Put it somewhere at the bottom or top of a page.

I 'm sure legally, you may not, but probably most artists wouldn't mind you "promoting them" that way, if you're just a little guy.
