Why? I don't understand it. Shouldn't a Father get immediate custody of a child if the mother and father split up and the Mother is a terrible parent.

Riddler...that is a ridiculous answer. So then a mother has a right to be terrible while the father has to go through legal precedings to take care of the baby, meanwhile the baby suffers because the parent is unable to care for the child just because she carried the baby for 9 months. No logic behind that.

drugs aren't an issue....both of us are clean and never do drugs. Its the fact that she doesn't take care of our daughter. I do everything for her and she does nothing and lets her suffer unless I travel from the town I live in now to drive to where she is to get her medicine. i don't mind doing it because my daughter needs it. I mean, if she can't take care of her and I can and have been, why should she get all the legal rights right away. I have been fighting for her by getting a lawyer and i have proof of her bad parenting. her own mother agrees with me and so does everyone else.

Do the right thing for your child, no matter what others do. Arrange for your child to have more time with you. Do Not make an enemy of her Mother, you will lose her. Ask for an extended vacation time, more visitation, fighting the system will only take resources away from both of you. Play the game, just be smarter.

Mothers don't get preferential treatment in CA but everything comes down to proof. You telling the court mom is an awful parent won't convince them. Generally the court won't disrupt a child's existing living arrangements while investigations are underway. Hire an attorney, get the most visitation possible, don't manipulate your child by bad mouthing mom, and you'll see that as the child grows up they will discern who the most capable parent is. You may be the refuge for your child in his teens when he really needs you. In CA 12 is old enough to appeal to the court on his own for you to have full custody.

P.S. Document everything! If you are clean from drugs and she is not ask for drug tests (hair, not urine) on you both. That will get your child faster than anything. If you aren't clean then what makes you think you are more fit? Get clean for three months B4 the test.

Precedent --- the law is driven by it ---and that was the thinking of the persons who set this as guide at the time !!
This has, for some time, needed review and change---but, alas, it will take a VERY gutsy judicial authority to even approach the issue-- for it is a long held concept (however wrong it may be) that a poor mother is better than the best of fathers (??)

The courts have always had preferential treatment towards mothers, unless you're a disabled mother, however I think it's starting to change and it should. Not all women are automatically good mothers or should even be mothers in some instances.

When the father starts carrying the child for 9 months & go thru labor & delivery then he'll have every right to have precedence.
