I have to tell you up front, I am probably more conservative than anyone you have ever met. I think capital punishment is a farce as we use it. When someone can live on Death Row for 20 years after killing a 5 year old child I just don't consider that justice. I consider justice delayed as justice denied. Life without parole doesn’t really mean it. A gentleman was released in from prison in Southern California after serving 16 years of a life without parole sentence. He was convicted of killing his wife for the life insurance money. The cash was to start a new life with a girlfriend. And occasionally we get a case where I have to scratch my head. A man named Scott Peterson is on death row in California for murdering his wife. The problem is, the body was so badly decomposed that no expert could testify to a cause or manner of death. I would have had trouble convicting him when the People couldn’t prove directly that a crime had been committed. I think the jury upheld the spirit of the law but not the letter.

In my opinion 18 months on Death Row should do it. I believe 30 days to file and 60 days to get the reply is adequate time for an appeal. So with that time frame we arrive at 90 days for State Appeals, 90 days for State Supreme, the same for Federal Appeals and Supreme Court. That would take a year. If all appeals are denied, do the deed.

So having said that, I suppose a direct answer to your question is about due. Yes I do think more crimes should be included. Some might seem very severe but IMO something has to be done. Kidnapping should be included; kidnapping resulting in death should be automatic. Rape should be included; rape resulting in death should be automatic. Anytime a Life without Parole sentence is appropriate, they can go to death row.

The jury should have the death sentence available: for child molesters, three time losers, habitual drunk drivers (especially when it has resulted in injuries or death), drug trafficking, and probably some things I haven't thought of yet. Additionally, anytime a death sentence is deliberated all prior bad deeds should be available so the jury can form a clear picture of the convicted person.

It may sound harsh, and indeed it is but I have never been accused if being a "touchy feely" guy. I look at these people as dangerous; to you, to me, to my family and to society in general. They are essentially the shallow end of the gene pool. I think as a part of an society they simply aren't needed.

I apologize, this was long and a bit protracted but the subject of the death penalty is, I am sure you would concede, complex. I feel like I have vented, thank you for the opportunity.

Yes. for Rapists, Child Molesters and Drink drivers because when they drink and drive in the car they are already on there way to killing someone.
