why doesn't phoebe have her empath power anymore in the last 2 series?
did the scriptwriters forget about it?

Because she lost that power when she used it for personal gain.

The top three are right - as far as it goes. She lost her empath power because the TV producers wanted her to lose the power of flight - as it cost too much to film! So she had to lose her active powers, and empath went with flight.

She was punished in season 6 for being too violent with her active powers and abusing them. They were taken away until she proved she could handle the resposibility once more. She also lost the power of flight.

Yeah, Kevin R is correct. She used her powers for personal gain so the elders took it away to punish her for her wrong-doing.
