Say your company makes a short video and uses a famous backing track that's then posted to YouTube . Can you be held liable and if so, who would pursue and what would their claim be?

If your video were to become popular enough that people or someone would notice that could take a financial gain in such a postage then they could claim that you were in a sense stealing from them, or a fun based purpose and your not trying to make money they could not legally sue or slap you with a copyright infringement law because you were not making any monetary gains

the most active group persuing this is RIAA for the recording rights to the CD. FYI they can also sue if the company displayed this video for any corporate meeting or similar promotional use. Profit is not a requirement for infringement. They would go after someone with deep pockets, ie the company that made the offending work in the first place is where they would start.

If the infringement was willful on your part, they don't have to prove any actual damages, they can claim statutory damage. Also the penalty for willful infringement can include confiscation of all the production equipment used to make the video.
