If you're that miserable, and he won't leave, then I suggest YOU leave. He has every right, legally, to stay there as long as he wants to. I'm not taking HIS side, just telling you his rights. Unless he does something that merits a restraining order, he can legally stay there from now on. You owe it to yourself to get out of that mess, even if it means YOU have to leave. If he wont leave, you will have to. I think that in NC, you need to live separately for a whole year before you can even get a divorce.

Why should he leave and not you, if your the one that wants the divorce, make a clean break and go.
