What can i do? In 2001 my Aunt died leaving me and some other family members beneficairies under her Will. To-day i have just found out bye chance that we have not received the final cheque from the solicitor, who is also/or was the executor to her Will. The file is now in storage and he is telling us according to his Ledger we have been paid. My brother hasn't had his either, what can i do, is it negligence or what? Only genuine replies please!!!!

The problem is that if he has sent out cheques, and if they have been cashed by someone else, there may be little you can do.

You will retain proprietary rights in the sums, so it could be said that the solicitor may have been negligent in not checking whether you had received the funds.

You should always start by making a complaint through the firm, each firm must have a complaints procedure. If they can't resolve they will give you various contacts to try and resolve, and also they must not charge you for handling the complaint.

I would say that it would be negligence. But do you have proof that the final cheque has not been received by you? You must have proof of such action.

And don't try to sue for damages, there are none.

If you are sure that settlement has not been made contact the Law Society with your complaint
