My friend was married for 10 years and his wife was a severe alcoholic, she wouldn't get help after asking her for years and he left her. She lost her apt. and went to go live with a friend, one day she left and never came back. People still hear from her from time to time and they know she's okay, but she won't say where she's living. I think she's hiding so he can't get a divorce.They don't have any children, property, or own anything together. He has found a great girl and wants to move on with his life, how can he get his divorce?

I believe that he can still file. He should consult an atty.

He should be able to get a divorce after waiting a certain amount of time. It is a year in this state he should go see a lawyer and file for a divorce stating the date that they parted ways.

He can still get a divorce. He needs to file for a divorce on grounds of abandonment. Then, after the time has expired and she hasn't made a counterclaim then the judge will sign the divorce papers.

As a divorce attorney, this is pretty easy, but different states have different procedural rules. He should be able to file the divorce and serve her by publication if he is unable to locate her after a diligent search.

Hi Lindsay, She has to be served with divorce paper before you can legally divorce her. I would hirer a private eye and have him track her down. I would pay him extra to serve her with the divorce paper. You will have a better change of finding her this way. A Friend.

After 1 year he can file on the grounds of abandonment and she wont be able to do much about it but tell him to speak to a layer now b/c i think you need some sort of proof that they left and he might have to fill out some paperwork.
