There is no straight forward answer to your question. It just depends on the circumstances. If the person is court ordered to enter rehab, then yes they can hold the patient, period. If the person signs away their rights, or the family is court appointed as guardian, or the person is a minor, then yes they can be held against their will (and even committed against their will). It just depends.

Yes. It's called an Involuntary commitment, or IC.
Basically the person has a court order ordering them to complete the program. If they leave, a warrant can be issued for their arrest. If they make a big scene about leaving, the staff can call the cops and they will be waiting when the patient walks out the door to arrest them.

If the person checks themselves in then there is nothing holding them there. The only way the can be held is if someone else checks them in, if they are a minor, or if its court ordered.

they can leave at anytime but if they are sincere about seeking help they will ride it out . if you are a friend or family member there are groups that you can go to that are 12 step meetings to help you understand what they are going through and to help give you sanity.
