The item was damaged over 3 months ago during remodling, he didn't think the damage was much, (small dent on display case) so he put it back up for sale. It never sold (he had it long b4 i started working there) now that im no longer working there, i am getting ready to pick up my last check and he is trying to deduct the value of the item out of my last paycheck. My brother said that stores can't charge customers or workers for accidently damage thats why stores are supposed to have insurance for high dollar items (its 350$) So im just trying to find out what i can do to fight this.

in general a store cannot charge you for the damage unless they can prove it was done on purpose. when an employer takes on an employee they are assuming the risk of what may happen by them having an employee. Should they persist in trying to collect from you it is illegal for them to deduct the cost from your pay check. they must per sue the cost as a separate matter. if they do not give you the full amount you are entitled to contact the labor relation branch of the government .they can be fined
