This is one of the biggest misconceptions about China. There are several exceptions to the "One Child Policy".

1. Indigenous people in China are exempt from this policy.

2. Rural families are allowed to have a second child if the first child is a girl. This is an attempt to correct the gender imbalance that exists in China today. This policy is known as the "Girl Care Project".

3. Certain regions of China are exempt from the "One Child Policy"; one such region is Tibet.

4. What Adam J said. Everybody else gets taxed for having more than one child.

Is a "One Child Policy" fair? Unfortunately, leaders have to make tough decisions for their country. China does have an overpopulation problem as a result of the mountain parable which suggested that if you have enough people you could move a mountain. As it stands now, China's population is expected to peak at 1.6 billion people before it begins to decline. They must do what is in the best interest of their country.

Well, for most Americans this might not seem fair and that's understandable. The current U.S. population is 300 million. But what will the U.S. do when its population reaches the 1 billion mark?. For sure, such a huge population will be a heavy strain on the economy. What will be its effect on employment, schooling, medical & social benefits, etc. as against the dwindling resources?. China's population is already beyond this 1 billion mark, and they decided to control the further growth of their population.

No way. What right does the government have to tell a couple how many children that they can have. This is also one of the reasons that there are so many "orphaned" baby girls in China because since everyone wants a son to carry on the family a lot of people who have girls will abandon them so that they can try again. Its really just a sad situation all together.

If one has any libertarian tendencies at all then the answer is of course 'no'. The Chinese government has adopted a one child policy in an attempt to muzzle population growth (you can have more than one child, but I believe it results in your family being put into a punitive tax bracket or something similar). Unfortunately because Chinese prefer to have sons rather than daughters for various cultural reasons this policy may have some pretty vicious side effects (including infanticide and a really large number of angry single young men down the road.)

The law was made due to the population explosion of China, it doesn't make it fair, that the goverment regulates what people can do regarding their families it is difficult to understand how this can be right in any society.

Yet it makes you wonder, what if the entire world had an over population, and this drained resources what then would other countries do?

The country is free and no I don't think it is fair. But China is greatly over populated and the government have to take measures to ensure it doesn't get out of hand!

China has a serious overpopulation problem. If they could have as many children as they wanted, their population would suck up all their resources and they would become subject to famine, cities which are too dense, endemics, etc. The law is preserving the well-being of the Chinese as a whole.

Well I think it is fair. It's the way they're going about it. THEY KILL the child if they are a girl or mentally retarded kid. They want their family name to go one. Bu tthere is to many people in china and the economic system will be better for each individual if there is less people.

I believe this is only in the cities. Those who work in the countryside are allowed two children. When too many people have too many children, something has to be done. The shame is that Girl babies are killed or thrown away because of cultural mores.

It's a good idea, if we had that in the UK we wouldn't have a bunch of benefit claiming, 18 year old mothers of 7 scrounging off the state and allowing thei kids to grow up as the next happy slapping generation.
