My phone arrived today from e2save.com (Clearance), was really surprised to find it had scratches on the casing and screen, will they believe me or think I made the damage myself?

p.s. sorry if this is a 'pointless' question they are not open till Monday and am anxious about it

Call them first thing Monday morning and report the damage on the phone. They should have enough faith in you, since you've just received it. Usually they will exchange it. However, if it is on a clearance, they might not have the same model.

It depends on the T&C of the supplier. If it was clearance it could be an ex display model. If it doesn't work fully as per specification then it's not fit for purpose and can be returned at no cost to you. If it's just cosmetic then you may be lucky.

the clearance phones are not brand new so you may not be able to exchange, but give it a go

you have nothing to lose - you are still within your rights to exchange as you should be withn 14 days of purchase.
