i got an xda orbit phone free with a new pay monthly contract from o2. can i sell the phone legally, but obvisouly keep the contract sim to use in another phone? might sound a silly question, but someone told me that i couldnt, and i thought i could as im paying for the contract sim, the phone was free!

Even if you got it subsidized, the carrier is getting their money out of the contract and you legally own the phone.

Feel free to sell it!

Look at the small print of your contract. Probably the phone remains the property of the supplier during the contract. If you sell it and use the sim in another phone they probably won't know, but you might need technical support, then they would.

Yes.!!! I got a Nokia N93 for "free" on o2 ... sold it for £400 on ebay...as long as you pay for your contract chip they are not bothered one way or the other if you keep or sell the "free" phone.. Go on Sell your XDA & buy yourself something nice..

you sure can - the phone is yourse as they have tied you in for 12 months - if you decide you want to stop early they will hit you with a fine but theat would be regardless of you having the phone that was a free upgrade

Many people do what you do to make their contracts more of a bargain

Done it before how are they going to know as long as you dont go back to them untill contract is up
