i just got my 2005 taxes done (i was single at this time-so filed single) & owe about $300 but havent filed it yet-i also got my 2006 taxes done & am now married & have filed 2006 w/ irs-we are supposed to get a return-will they still send it or will they place a hold on it or will they take out what they think i owe?

It depends.

Odds are if you have not been contacted by the IRS about not filing, your return this year may just go through without problems.

Or they will hold it and contact you until after you pay the 2005 amount and fines and penalties.

As I just read an article about how the IRS wasted billions of our money on a computer system that doesn't work correctly, you will probably be ok.

But get them filed soon, everyday you delay is more money you will owe the pr*cks.

Well I got the notification from the IRS about not sending mine in. I just had my 2005 and 2006 done at the same time and they owe me on both. I E-filed the 2006 and paper filed the 2005 and they havent given me my 2006 back yet so I am assuming they are waiting till they process the 2005.

The assessment of your 2006 return will not be affected in any way by you not filing your 2005 return. It is a separate process. If there are things like loss carrybacks it will be included on your 2006 Assessment Notice. If you have no income in 2005 you do not have to file a return unless you are requested by CRA to do so.CRA has a "matching"program that matches employment, pension, investment and other income with individuals that choose not to file. In situations where there appears to be a debit CRA will first request a return and then do an arbitrary assessment if no return comes in. As you have no income then you will not be on this system.If you had business or self-employed income in 2004 or earlier CRA might still do an arb for you under the assumption that you are still in business but they will request that you file first. However it is a good idea to file a return for 2005 to get it on record in case you have problems in the future. For example if you need to make a fairness claim you have to have all returns filed up to date. Late filing Penalties and resultant interest are charged only if there are outstanding taxes due on April 30 in the year you are filing for.

You don't "get" a return, you FILE a return. Maybe you're expecting a REFUND. A refund is not a return.

If you didn't file your 2005 RETURN the IRS is probably not yet aware of the tax debt so they won't be offsetting your 2006 REFUND yet.

When you file that 2005 RETURN, enclose a check for the outstanding tax, penalties and interest with it and you'll be even-up with the IRS. If you don't enclose a check, they'll send you a bill for the outstanding taxes, penalties and interest.

If your 2006 refund hasn't been processed when they process your 2005 return, and you don't enclose payment with the 2005 return, they'll deduct the 2005 balance due from the 2006 refund. Most likely they'll process your 2006 return first, especially if you e-filed for 2006, so you'll have to send them a check for the 2005 balance due.

They might take the $300 out of your refund, but probably not since it doesn't sound like there has been time for paperwork to catch up with it yet.
