My little girl biological dad beat her when she was a little baby he went to prison and is set up for a parole hearing in july.
Well last month I found out The great state of Texas didnt take away his rights reason the child was not taken out of household so they didnt see the need. So I need advice from anyone who was done this. cause his dad hates him and wants to stay in her life so how can I tell them without them thinking I am taking her away. It isnt against his parents just her biological dad.
I need to what to expect when me and my husband proceed with the case. My husband wants to adopt her

Seems like it would be easy but this isn't the case. You didn't mention if he wanted to fight hook, line, and sinker for her though...if he does and he hires a good attorney....then they will try to prove....he made mistakes and now he is fully 'rehabilited' and maybe even still going to counseling.....this abuser then, would be doing more than the average daddy if you see what I mean...and no judge wants to deny a father his rights when they are willing to give it all they have....hope that isn't the case in your situation...maybe he'll wise up and not want to go to prison again and just sign his rights away willingly.....good luck!

This should be an easy one. If it can be proven that the biological father physically abused the child before going to prison, his parental rights should be taken away. This man would clearly not be a good father or a positive role model for this child. It should be as easy as showing the family court proof of abuse.

go to court prove him an unfit father. if he was already in prison for abuse, it shouldn't be that hard.
