Isn’t it a crime to kill someone well committing another crime?

Very few murders are murders in the first degree. That being said for murder there must be intent. Therefore, killing someone with a car is not murder because the intent to kill was not there, it was reckless, therefore a different crime in the eyes of the law and cannot be covered under a murder statute. Basically its all in wording.

Murder in the first degree means that you thought about killing someone, decided to do it, planned how you were going to do it, and then did it. That's why it's also calld "premeditated" murder.

Vehicular homicide means you committed a crime with a motor vehicle which resulted in someone's death, and the act was done without premeditation.

Believe me, I'm no fan of drunk drivers, but I have yet to meet one that said, "I'm gonna go get drunk, drive my car, and kill someone on purpose!"

Murder 1 must prove intent, that it was planned out even 5 mintues before it happened. Anyone who drives drunk is mentally impaired in their judgement and cant be making any kind of responsible decisions. Obviously, thats why we have so many deaths as a result of drunk drivers. Did they intend to get drunk and kill someone, most likely not, but did they think they could handle being drunk and driving, yes, so the responsiblity is theirs for what ever damage they cause, intentional or not.

the difference is whether or not it was in tensional .....if you meant to kill some one it would be premeditated murder....if it came about out of anger but not preplanned....it would be first degree murder......if it came about from unintentional recklessness....then it,s homicide.
