If I ever caught my husband doing something like that, his balls would be out the door before he would be! If he is doing something like that in front of someone who already knows what he has, then he had intentions. And I would really start thinking about moving on because if he did that, which was really showing no respect for you, then you never know what else he might do. So I wish you luck, and hope you get everything taken cared of soon before it destroys your self respect and esteem.

Legally, I don't know. Morally, it's I think a matter of what the parties consider what is right is right and wrong. Masturbation is a sexual act. Performing it in front of someone you have,in the past,been intimate with,might in some peoples opinion, be considered nostalgic, bringing back past times.
You see ,it depends,strongly on the people and the circumstances.
Is it a sexual act between 2 people? Yes.Now, is it cheating?
Damn,ya know,I don't know ,really,what cheating is.Take swingers;they love their partner but have sex with someone else and don't consider it cheating. It's a physical thing and apparently enjoyable.
The situation you are talking about may be parallel. If The person who masturbated in front of an ex yet still loves the person they are with now ,then maybe it's not cheating.
Loving someone ,truly loving someone is beyond the physical.Loving someone is the everyfreakin'day hum drum life we tolorate as a pair and still looking at that partner and sayin' " luv ya babe,we gonna be alright"
