Nowadays we see that the supreme court judges can be purchased or if you are an influencial person in the society or a wealthy politician, you can get the verdict as per your wish. It is practically proved in many cases. While most of the ciriminals have turned to politics to become more and more powerful and wealthy, the poor people are the sufferers. Unfortunately, the public are barred from commenting upon our judiciary or any verdict or a judge. In what way they are superior than a common man and after all they are also human beings and they are bound to commit errors. In many cases, the supreme court has stepped in and scrapped the lower court's order. Under such circumstances, what is the credibility of the Judge from the lower court and is there any punishment to him for having erred in his duty.
I would like to receive a frank opinion on this.

When the entire society is corrupt the reflection will be there everywhere including in judiciary. We can not bring people from MARS to run our institutions. What would help is, improve upon our values by proper education and upbringing of children.

All of us have roles to play in this long drawn endure.

Dear Mohanaprakasam,
Our judicial system is based on the doctrine that even 100 criminals escape, not even one innocent should get punished. Hence the transparency in trial is given much importance. That results in adjournments and delays. Usually our litigants, politicians and the lawyers take advantage of this.

Any judge can decide a case based on the facts presented by him by both the parties. They are barred from making any investigations on their own. This may cause taking sides. Hence these lawyers present half truths before the courts and bend the justice to their tune.

Take the case of hoardings and petty shops on the road margins with the words at the bottom "Under Supreme Court/High Court stay Case No. xxxx". Usually the law enforcers and the ad consultants conspire together. The ad consultant gets a stay and the case is not protested by the authorities concerned for decades together. Is keeping a hoarding on the road side is so important an issue to be resolved by the Supreme Court.

Take the case of burning of TNAU bus near Dharmapuri. When AIADMK was in power the witnesses were threatened and defaulted in their evidences. But when DMK is in power maximum punishments are given for the culprits.

Take the land acquisition cases. Government acquires lands for public causes. It has well established system for fair valuation. In spite of this the land owners file cases for increased compensation. They file doctored evidences such as sale deed of a very small piece of land (few square feet) in the vicinity. Based on this small piece the prices of large chunks of land (Running to few acres) are extrapolated by the courts. But neither the revenue department nor the land acquiring department project the simple fact that the comparision is not logical as in case of large extent of lands the large areas have to be left out of roads and other infrastructure etc. Ultimately the poor beneficiaries (Land allottees in the case of Housing Boards) are asked to pay. Had these beneficiaries also were part of the legal proceedings then the outcome may have been different.

Of course, there are few cases of involvement of Judiciary officers also in this process of taking advantage of this system. But I still believe they are rare and far in between. In spite of all these system faults, the judiciary is one pillar which is comparatively less damaged.

It is impossible to wipe out corruption completely. The best that can be hoped for is to quell it when you see it. As long as there are human beings on the face of the earth, there will be some form of corruption going on.

IF ALL THE LIGATING PARTIES HAVE GIVE AND TAKE POLICY. INSTEAD OF APPROACHING THE COURTS FOR ANY KIND OF LITIGATION THE PARTIES CONCERNED THEMSELVES SIT TOGETHER AND COME TO AN UNDERSTANDING AND MAKE A SETTLEMENT BETWEEN THEMSELVES.
