Law is not equal for everyone.In Meghalaya,maternal marriage system exist,where women are predominant&men are brought home after marriage.Dowry exists only in certain parts of the nation.&if the women have problem with that,she shouldn't have married that person,she can get better person to marry elsewhere.Modern women are outspoken,smart and well educated.They cannot tolerate even a harsh word that her in law tell her for the betterment of the complete family.And now the new law further gives power to her.Even if her husband is angry on her for certain domestic affair,he will be imprisoned for one year.Indian penal Code 498(A) and Domestic brutality act on women Act,2006 empowers women to destroy peace of the family and also to break the unity within family members.In-laws and husbands are forced to obey wives order.A real statistics figure will tell how much actually these laws are helpful to needy women of the society.They are more misused than actal use.Where is the equality?

I fully agree with you. Being a lawyer I know there exist lot of inequality for both man as well woman in today’s India society as well laws enacted so far. The reason for all this because of non implementation of common civil code that has been promised in the directive principle of the India Constitution but because of the pressure from various religious people the central governments till date have never is able to implement this. You may call it their weakness or vote banks in these minorities’ religious people. Its a misconception that Dowry is there in only certain parts of the country,its there everywhere,like termite, gnawing away at society.its there in every strata of society. i am educated and speak my own mind.what's wrong with that? every day, women are being BURNT alive for dowry. are men being burnt? why are inlaws harsh? a girl is already scared to be part of a new family. NOBODY should have the right to interfere b/w husband and wife. ..whethet its the boyz family or the girlz. its time that india rises above the antiquated society norms to give girls also some breathing space. i am not saying that girls are right in every divorce or police case, but i believe that husband n wife shud be given a chance to form an understanding without interference from other people.no girl would like to marry a mama's boy. indians are a frustrated lot becoz they dont want to work hard to provide for their families. thats why the greed for dowry.

every law has pros and cons. it is double edged blade. if the law enacted is misused by some women, it does not mean that most of the women do not require protection from the government. not only this section, but also several other sections of Indian penal code are being misused by some people.what about the dowry deaths and harassment of women by men , every day we are seeing?

Widespread Misuse of Help Us to Stop Dowry law (IPC 498A)


Dear Citizens of India,

Do you know how vulnerable our life has become with the growing misuse of dowry laws in India? IPC 498A was enacted to deal with dowry harassment on women by her husband and in-laws. The law is defined as Non-bailable (you have to move to court to get bail, cannot get bail at police station), non-compoundable (once put against you, cannot be taken back at will) and cognizable (police can arrest without warrant and investigation). The above law being susceptible to misuse has become a weapon of some modern liberated women to torture their husband, in-laws and other women in the family. The Police will immediately arrest the accused including old ailing in-laws, pregnant women and young kids without adequate investigation. In most of the cases the accused get acquitted because the complaint was not based on factual evidence. Even after truthfully acquitted (which takes several years), the innocent husband and his family members have to bear intense criticism and contempt in the society. Such misuse of laws damages the family including women and in many cases they are pushed to commit suicide.

As a result, Police have become more skeptical due to the incidents of such misuse of laws on a very large scale especially in the urban areas of the country. It would have been fair if such laws act as a protection to women from such unlawful dowry demand. Unfortunately, the law has also been misused to get even or gain score or even to extort money from husband and in-laws. However, the law did not curb the dowry deaths in rural areas as expected but it is getting grossly misused in urban areas. There are still number of women with a genuine case that have been skeptically investigated because the law has been vastly misused and the Police would not want to arrest innocent people. Therefore, because of rampant misuse of this law, genuine cases are not taken seriously for which the police can't be blamed since arresting innocent people is injustice.

Supreme Court has termed misuse of IPC 498A as Legal Terrorism and shows its inability to change the law is it is passed by the Lok Sabha. US State Department issued a travel advisory/warning regarding misuse of IPC-498A to NRIs who come to India to get married. In year 2003, World Health Organization (WHO) published a report on "Abuse of Elders" across the world. This report specified the legal abuse of elders including women in India where many daughters-in-law file false complaints of cruelty (IPC u/s 498A) against them. Countless daughters-in-law are demanding the in-laws to distance themselves from their sons and live on their own separately. Unaware of law in India, some husbands/inlaws harass and subject the brides to mental & physical cruelty. They wants to dominate and control wife forcibly and restrict her from natural, fundamental and legal rights. They treat her as purchased property, slave or maid servant for inlaws' family. In Hindu marriages, bride is donated (Kanyadan). Her parents had to pay huge cash, gold/silver, costly articles/cloths, flat/house etc. for marrying her and continue fulfilling such further demands. Should husband/inlaws restrain/restrict a wife? They should know where they are and legal position so escape prosecution and punishment. Instead of correcting themselves, a few wish and pray that all others should also suffer like them.

In India there is age restriction for marriage (not for unwed sexual activities), 18+ for girls and 21+ for boys. If married, the under aged their parents/elders and others who got performed such marriage will be punished under Child Marriage Restraint Act.
Premarital, extramarital or unwed sexual activities (intercourse / coitus) are not barred / prohibited and are no offence in any Indian law. Wife’s sexual intercourse with other/s is also no offence, hence no prosecution or punishment to her. Even her sex partner also cannot be punished, if was unaware of her wedlock or had sex with consent or connivance of her husband. However the police cannot arrest or prosecute him. After divorce also her husband is bound to maintain or pay till she remarries, even if she is permanently / continuously enjoying sex with all other/s. Pre marital sexual experiences (intercourse / coitus) with other/s cannot be a ground to seek divorce under Hindu/Special Marriage Act. Thus a female’s physical sexual relations with persons/s of her choice (with their consent) is not an offence or prohibited / barred in any Indian law and she is at liberty to enjoy SEX freely and fearlessly. A male’s physical sexual relations with any 16+ female (with her consent) is no offence or barred / prohibited in any Indian Law, unless she is in the wedlock of somebody else and is done knowing her wedlock and without her husband’s consent or connivance. Courts are bound to believe that all children born during the wedlock (or within 280 days of court's divorce judgment/ decree) are her husband’s legitimate ones. He is bound to maintain or pay them expenses, till sons are 18+ and daughters are married. Prostitution (commercial sex trade, offering sex for monetary gain) alone is an offence punishable in Indian laws.

All unwed sexual activities (pre/post/extra marital), homosexual acts, & other perverted sexual acts are specifically forbidden in Islam. In Islam, unwed voluntary sexual intercourse also is a great sin and heinous crime against government/society punishable with publicly lashing/ death by pelting stones.

Muslims firmly believe and strictly practice the teachings/commands of their holy book Quran & their Prophet, which is their Code of Life at all times/places. They have the written, clear and unambiguous teachings to guide righteous or wrongs, pious or evil, fair or unfair, etc. They follow them blindly in matters of responsibilities, liabilities, rights, daily life, marriage, private & public relation, business, trade, earning & spending, etc. and do the righteous and refrain from bad. Anybody may read, satisfy, accept and practice it.
