My fiance is getting ready to go to Iraq and he wants to set up a power of attorney for me, so when he is gone I can sign things for him and if his kids need medical attention then I have the right to sign for him. I need to know how to go about setting this up.

You will need to set up a temporary or limited power of attorney ,Not a regular power of attorney .It is best done through a LAWYER but you can buy a computer disk at Best Buy ,Office Depot and others .one is called You and The Law ,but there are others .They help with legal matters buying a home codicils just a lot that may come up .
You just go in find what you want ,fill it in and print it off and sign in front of a Notary

Speak to a local lawyer, seek his advice. Remember this is very simple legal procedure, look out for some over-billing tactics.

If you don't like dealing with lawyers. you can write up the document yourself to this effect as long as it contains your fiance's consent. You may also need to specify the extent of the power: it does vary from case to case.

In some jurisdiction, It is mandatory to have a witness of the procedure and ask him/her to sign at the bottom of the paper.

Legal requirements on setting up powers of attorney vary by state. Your fiance should visit the local JAG office...I believe they provide this type of information for free and may have he necessary forms for your fiance to fill out.

All you have to do is go down to Staples (that's where I got mine but you can go to any office supply store) fill everything out except for the signatures portion. Then go down to your town hall or probate office (if you belong to Navy Federal Credit Union you can also go there) and have it notarized. Be sure to bring proper ID such as you dependant ID, Social Security Card, and his military ID. Both of you must go together. By the way you do NOT need to go pay a lawyer to have this done! Go to you local courthouse to the circuit clerks office and ask for the paper work for power of attorney, it can be completed on the spot and won't cause you anything except for a copy of the order.

The law is different at different jurisdictions; so go to a lawyer with experience on family law. If you make a mistake the power is void, so go to a lawyer.

Why woulddn't you want to be eligible for benefits

You are setting yourself up for disaster is he should die.
You will have no right ot any benefits!!

I know because my husband was injured in Vietman.
I was able to collect his pay/combat pay as his wife and keep going.
