I am temping at the moment through a recruitment agency. The employer is now offering a permanent post. The agency is aware of this. However, I am going on holiday next week for 2 weeks & the employer says they will draw up a contract after coming back from holiday. Everything is verbal up to now.

Do you think I should gently persuade the employer to draw up the employment contract before I go on holiday or take his work for it (the fact that they will be willing to take me on permanently) & wait until after I come back from holiday.

If you can't take his word from him before you start..........do you really want to work for him in the first place? I think it's great that he is waiting until you're back. They may not need you right now and it would be better for them when you get back. If they are going to hire you.........they're going to hire you. You can't persuade them to expedite the process or you'll come off as being overbearing. He's the employer, so he's the boss. Let him have the control and run the show. You have a verbal and that's more than most. Just relax, enjoy your holiday......and everything will work out. I know you don't want this slipping through your hands so you want something in writing now. Employers don't give a verbal without intending to honor it.........congratulations.

No. You should have negotiated a lesser time period, or an "in the event of.." provision. Since you didn't, you have to abide by the contract you agreed to voluntarily and in good faith. Breech could open you (and/ or new employer) up to significant liability, if the current employer wants to pursue it. I recommend that you talk with the new employer to determine if the job can wait 4 weeks, or find an alternative solution ( for example, work for current employer during the day and some time at night for the new employer).

If your recruitment agency is aware of this you have no problem, however in UK law a verbal contract is binding, but all the detail must be draw up in a contract and signed by both parties.

Depends on whether the company is reliable and whether you trust his word!

Personally I would say to them that if the contract is ready I'll sign it now then can start straight back to work when you come back fron holiday - you never know with employers - while you are away they may get another temp in and he might be more suitable and then they'll offer the job to him and you'll come back to nothing!

I would say go with your gut instinct, if you think they may not hold the job for you then ask for the contract before you go, you'd have a nicer holiday knowing that you've got a full time position to come back to.

if they are genuine they won't have a problem drawing up the contract first.

If you are in the Uk then legally s/he is only obliged to give you that contract within 3 weeks of you commencing employment. Having said that you could ask them to put their offer in writing woth a start date before you go on holiday.

Well if they want to take you on permanently that must say something for them.

Always get everything in writing. You might even get them to e-mail you something (sneaky but effective).

I would take his word for it. It would not look right for you to push. It is obvious they want you or they wouldn't bring it up.
