she has been with this guy seven years ,he is a ex drug abuser and now he is in rehab, he is a sorry excuse for a human being , she recently married him in december of 06'. it was her dream to marry him but he hasn't changed a bit . he sleeps day in and day out,does not work, will not get up and help with NOTHING ,jumps on to her for talking to friends on phone, but he's the one that want get out of bed to talk to her , she has a brand new car HERS and he jumps onto her for driving it , says she'll get it nasty ,
and want have sex with her,all he wants is to watch f--- flicks, thats not right ,he goes out and no matter what he finds thing to try and get her buy and guess what shes gulliable she buys it , she wants a devorse what should she do , she checked it out on line and she cannot get a divorse for a year . or can she get it quicker? PLEASE NOT SMART REMARKS I FEEL REALLY BOUT HER SITUATION .

She may not be able to get a divorce immediately but she should seek legal advice, she may be able to have the marriage anulled, which is not a divorce so he won't get any of her money. Legal advice is definietly the way to go with this one and she needs a lot of support so she doesn't fall into any traps with this guy. If she wants to go ahead with it she should sever all contact with him and she'll need lots of support from her friends and family to do it.

First of all, if she doesn't have kids, she doesn't need to wait for the divorce. She should leave right now. If she has kids, things get tricky, but I still find it hard to believe she can't get divorced for a year (unless he's contesting it). If he isn't fighting the divorce, hire a paralegal to draw up the papers (it'll take a couple of weeks). Then show up at court, and you're done. The complication comes if there are kids involved or if he's fighting it. Then she'll have to hire an attorney. However, just because she's still legally married to him does not mean she needs to stay in the same house with him. Does she have family that would take her in until the divorce is final? My sister actually left and went to a homeless shelter to get away from her abusive husband. They help you get set up in an apartment, help you with job search, child care, medical care if you qualify etc. You don't pay for this service, but there is a time limit on how long you can stay (I believe it's 2-3 months but I'm not certain).

Is she asking for your help? Just be there for her. That's all I see that you can do. At least the guy's in rehab, give him that. She loves him so try to be positive about that one positive point. When he gets out, if he doesn't have a new attitude and start being more affectionate and get a job, you can step it up and gently encourage her to move on. You know he'll only bring her down and you want your friend to feel good about herself, so tell her so then without trashing the man she can't help but loving.

I don't know why it would take so long to get a divorce. It only takes 3 months in Arizona.

By this question I am assuming she is in South Carolina, that is the only state I know that still has this blue law. She can still file a legal seperation. Tell her to go to a lawyer and file. It is best if she has somehere to go. If the house, trailer, etc. is in her name, clse the lease and let him find his own place to stay. The biggest help in these situations is support. Tell her to leave him, kick him out, and worry about the divorce after the year is up. She doesn't deserve to be treated this way. At least she finally figured out that he is no good, that is the biggest realization and best step. Now, she needs to distance herself from him. Just keep her spirits up, be encouraging. Be the good friend that you are and let her know you'll always be there for her. Let her know that she will eventually find someone who will love and respect her the way she deserves.

Why would she have to wait a year for a divorce? Is she from another country waiting for citizenship? Tell her to get a lawyer or find an agency that will hep her. He does sound like a loser!

it's hard 4 her to leave him after all he was her dream guy an he has brought her self esteem down she would either have to leave that situation forcefully (trying to reason with her to get her to see the the facts of what he's doing to her) as u bein her friend you may be able to persuade her.

i feel sorry for ur friend. but i wonder she married him? he's a total jerk u know. anyone read ur question will also think he's a jerk! useless. i think ur friend could move out to different house but a safe one. maybe her family's house. or yours. just for her protection maybe he'll get mad about her moving out. and then she can get a divorce afterwards just to make her life with his jerky husband end. that's just a thought. :)
