My wife is a cheerleading/tumbling instructor/coach at a gym. She cheered in junior high, high school, college, and indoor football. She is 25 years old, a mother of one, but can still do it all. She is Certified in her profession to teach the techniques with the national board. She has years of experience to back it up. Plus success rate of girls who came to her and either made the team or accomplished a goal they didn't have before. She recently tried out for the National Cheerleaders Association, you know the one's who teach teams and squads what to do, because it was something she always wanted to do but just never did. She was rejected. They told her that they chose from college kids first, then highschool, then returning vets. She was crushed, she really worked hard for this and loves teaching kids the technique of cheerleading and tumbling. I feel like that's crazy I would want someone with experience and who knows what they are doing to be on my staff. Help me.

Oh my! I can certainly relate to your wife. I was also a HS and college cheerleader and am a current cheer coach. 25 is definitely not "over the hill". She has the expertise and experience, and should not be glossed over.

If they are indeed following a certain agenda for placement, I would suggest that your wife enroll in a college class. VOILA, she is now a "college student" and any deviation from their stance at that point would certainly be age discrimination.

Age discrimination exists, even though it's not suppose to. There are so many excuses to get around the real reason they don't hire you. I'm also having a difficult time finding employment due to outsourcing. Our small city is a college city. Most of the jobs are held part-time by college students. This saves the companies a lot of money on not having to pay benefits. I'm very discouraged right now with our current economy, and business practices. I find myself resentful and discouraged. Just because I have a family to support...and I'm not a student anymore, and over 40, doesn't mean I'm not going to make a valuable and dedicated employee. I don't know really how to answer your question, I just can emphasize with your wife. I hope something even better comes along for her.

unfortunetly they are not breaking any laws. If they specifically did not choose her due to her age there would be an issue. However, they have a process in place to pick from the students / high schoolers / then the returning vets. Seeing how they have this system in place it keeps them legally 'safe' from discrimination.

Unfortunately Title VII doesn't cover age discrimination. The Age Discrimination in Employment Act, (ADEA) does but only for people over the age of 40.

It doesn't look like you have any legal recourse.

Tell her to do this. Have her apply once a week till these guys get the idea that she is really interested. If she sends in enough info they may say hey, let's hire her so we can quit getting mail from her. Be persistent and be friendly.
