Brahma is only the God of creations. The question you have asked occurs in the Mahabaratha itself when Dridrashtra the blind king & father of the evil Duryodhana, tells Lord Sri Krishna himself that, whatever wrong his son had done was only due to Brahmas writings. For this the Lord replies as follows. " The creator gives you your body with all its parts with an insense. Only those accidents or problems in your body which occured at birth were given by him. That was also the result of wrong doings of the past. Your insense is your greatest gift with your brain. You can decide what is good and what is bad." Thus spake the Lord. Now, I think you can get your answer. whatever good or bad you do is not written by Brahma. Thieves or criminals do have an insense and whatever crime committed by them is completely answerable only by them. For whatever crime they commit now also becomes karma, which Brahma says that they should experience in the form of accidents, birth in a poor surroundings or birth with sufferings.

The stories associated with the names of gods should be understood as allegories, to drive home certain theories. Hindu religion emphasise on the karma. All that happenings in life is the result of ones past karma. One has to undergo the consequences of the karma. Our karma is our destiny. The creator is the one who ensures that the law of karma works in the cycle of birth and death.
