I just started renting an apartment this week. Not even moved in yet, and I noticed that the refridgerator has a crack on the bottom shelf and I can't even put any pressure on the shelf at all. Are they responsible to replace it or do I have to?

tell the landlord to include that on your walkthru, it might not be a big deal but protect yourself at all costs.

The first day you moved in the Superintendent/Owner and you should have done a "walk through", all items of disrepair would be noted and the work completed. That is the law. Unfortunately you didn't know that, so this is what you do. You call your super/owner (the person you rented from), and you tell them about the fridge, and you get them to come to the apartment and do a "walk through". You start looking around for any other repair, check the washroom, sink, windows, floor, doors, handles, etc and make a list. Cover your "a**" If this is your fist apartment, you could be taken advantage of. ps:you could speak to a long term tenant and find out just what the maintenance is like in your building.

Make sure the landlord is aware of this when you take over the apartment. Get it in writing. Hopefully he'll replace the shelf.

See is appliances are covered on the Lease, that's if you have a lease, some landlords don't believe in them...at least they don't here in Westerly, RI The past 5 apartments we rented we never had one. Good Luck.

You should have let the landlord now this all during your inspection, that's what it's for. Your still not liable but, that doesn't mean they won't stall you. I would let them know that you missed it before you move in. You want it replaced. If they'll sign a statement that you notified them, all the better. managements do change, I got caught in one like this. Insists they change it or acknowledge it.

If you have not moved in yet, ask for an inventory sheet. You walk through the apartment and make notes of EVERYTHING you can find.

Nothing is too small to make a note of...stains on carpet, mildew in bath, etc.

This is your only chance to release yourself from pre-existing conditions.

If they own the appliance it's up to them to have it repaired.
