It doesn't say when the video was done. I think it was done when he was dating Payton though. He wouldn't cheat on Haley. If he turned down Rachel he would turn down Brooke.

Nathan and Peyton had just broken up for the bajillionth time and Nathan and Brooke got drunk and made the tape. But peyton and nathan were not together at that time, but they did get back together later.
